We reserve the right to take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the services.

4. Prohibited Activities

In addition to the Acceptable Use Policy, you are prohibited from:

  • Using the services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the services.
  • Using any robot, spider, or other automatic devices, process, or means to access the services for any purpose, including monitoring or copying any of the material on the services.
  • Using any manual process to monitor or copy any of the material on the services or for any other unauthorized purpose without our prior written consent.

This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these Terms are reserved by Domain.

6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise transmit content through the services ("User Content"). You retain ownership of any intellectual property rights that you hold in your User Content. However, by submitting User Content, you grant cloamd a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

You represent and warrant that you own or have the necessary rights to use and authorize us to use your User Content as described in these Terms. You agree that you will not submit any User Content that is unlawful, defamatory, obscene, or otherwise objectionable.

cloamd reserves the right to remove or edit any User Content at our discretion, without notice, for any reason, including if we believe that such content violates these Terms.

7. Payment Terms

Access to certain features of the services may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on our website. All fees are non-refundable unless otherwise stated in these Terms or required by law.

In no event shall cloamd's total liability to you for all claims arising out of or relating to these Terms or your use of the services exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

10. Termination

We may terminate or suspend your access to the services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
